Lawyers have presented their final arguments in the trial of Alan Ellis. The prosecution slammed the ex-OiNK admin, saying that the site was set up with dishonest and profiteering intentions right from the start. The defense tore into IFPI and countered by calling Ellis an innovator with talents to be nurtured. Today the jury returned a unanimous verdict of not guilty, and Ellis walked free.

"Florian Hufsky and me got to know each other when he was about to leave the Carinthian province to head for Vienna, just having founded the Austrian Pirate Party with some friends. But in 2006, the Pirate Movement was still a paper tiger as it communicated online only, - digital grassroots, yes, but still `speaking into the air´.
The connector between us happened to be Johannes Grenzfurthner, good times for collaboration in Vienna evolved in lots of niches, labs and talks. The very next year, in 2007, Florian and I were inviting some of the founders of the Pirate Movement from Sweden to Vienna. As a side effect of this invitation, young pirates from many neighbouring European countries, from East and West, made their journey to experience their first real-space meeting, the Viennese hackerspace Metalab providing beds and breakfasts on the fly.
This crowd of courageous practitioners, - students, entrepreneurs, political activists -, shared some time in sunny Vienna, they got to know each other in person, they discussed, they advised each other and began to plan for the future.
The fact that this meeting was realized has been mainly thanks to Florian´s initiative, his enthusiasm to leave his mark for a cause worthwhile fighting for, - the freedom of us, real citizens, in the digital age -, and his wish to bring people from diverse European countries as well as diverse political and societal backgrounds into a space of shared understanding and shared problem solving. Another two years later, in 2009, the Swedish pirates were able to send their first delegate to become a Member of European Parliament, their adventurous journey from online media to meeting real people to entering the official political system has been successful, one breakthrough has been achieved, against all odds. It needed faith, it needed constant learning, it needed courage and a mind set on clear goals.
And yet again, another two years later, in 2009, close to 850.000 German voters in universities,
new media clusters and vibrant city centers opted for the change Florian was so engaged for, opted for politicians and industries to get more alert, to again respect our fundamental citizens´rights. For these rights, our ancestors had been fighting and dying for in centuries, in East and West, hoping that Europeans may start to collaborate enough to leave behind the legacy of its dark historical epochs, the stigma of its numerous political failures in the past.
Through the internet, we all may cease to fight for one territory only, we may also cease to fight alone. Yet in the end, it will always boil down to real persons that start to care for their `res publica´ of the 21st century, entering the process of articulating the meaning of `freedom´for contemporary challenges.
Florian has been able to, indeed, leave his own mark in the very beginning. But he is no longer with us, multiple blogs are mourning his departure. Still lacking my own words to express my grief, Rick Falkvinge´s words shall speak for me: »This is truly saddening news. Florian was one of the most inspiring people I knew within the movement. He could move me to tears.«

Once, in a moment of co-inspiration, I chose to skip the casual "Hello" when meeting him accidently some place in Vienna, instead I shouted out with jubilation: "Oh, the Hufsky Experience!" before we would hug each other. Florian got to like this play on words and we exchanged it many more times after that.
Of course, I expected to experience him again and again over the years, stages that are supposed to naturally arrive in a human being´s lifetime, seeing him create more art or found a business, watching him starting to teach, wishing him well when founding a family. Like many colleagues, I believed that he would be granted the time necessary to mature and to find his place among us step by step, a task that proves to be quite difficult for many a young talent nowadays.
By passing away, he leaves a vacuum that many of us in Vienna find themselves unable to deal with. We miss the "Hufsky Experience", we are missing you, Florian. Take care, wherever you are. You will not be forgotten."
